This End User License Agreement ("EULA") is a legal agreement between Whisk Mobile Development Pty Ltd ("Company", "we", "us") and you ("User") governing your use of the Workout Writer application ("App", "Application", "Site").
Workout Writer uses Apple's Standard End User License Agreement as its base license. That agreement is incorporated here by reference and applies in full.
In addition, the Workout Writer EULA Addendum below sets out application-specific terms relating to workout creation, user-created and shared content, subscriptions, lifetime access, paid upgrades, AI-generated workouts, prohibited conduct, and the assumption of risk.
If there is any conflict between Apple's Standard EULA and the Workout Writer EULA Addendum, Apple's Standard EULA shall control except where prohibited by law.
The App provides tools that allow users to create, edit, organize, and share workout descriptions ("Workouts").
The App does not provide fitness instruction, training plans, coaching services, or medical advice. The Application functions solely as a content creation and organization platform.
All Workouts are used at the user's own discretion.
The Application is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or injury. Using the Application does not create a professional health-care relationship.
Workouts—whether created by the user, shared by other users, or generated using automated features—are provided for informational purposes only.
You are solely responsible for determining whether any Workout is appropriate for your health, fitness level, experience, and personal circumstances. You should consult a qualified medical professional before starting any exercise program.
When you share a workout via a generated link or file, you grant the Company a limited, non-exclusive, royalty-free license to transmit and display that content on the devices of users who choose to import it. You represent and warrant that you own or have the necessary rights to share any content you create or distribute through the Application, and that your sharing does not violate the intellectual property or privacy rights of any third party.
The App may offer paid access to premium features through App Store in-app purchases, including auto-renewing subscriptions and a lifetime access option.
Auto-renewing subscriptions provide access to the premium features described in the App at the time of purchase for the subscription period shown in the purchase screen. Subscriptions automatically renew at the end of each billing period unless cancelled before renewal through your Apple Account subscription settings.
The subscription name, duration, price, renewal terms, and included features will be shown before purchase. Any free trial, introductory offer, promotional offer, or discounted period will be described in the purchase flow, including when billing begins and the price that applies after the offer period ends.
You can manage or cancel an auto-renewing subscription through your Apple Account settings, the App Store, or Apple's Billing and Subscriptions support page. Deleting the App does not cancel an active subscription.
The lifetime access option, if offered, is a one-time in-app purchase that does not automatically renew. Lifetime access means access to the paid Workout Writer features included with that purchase for as long as those features remain available in the App, subject to these Terms and Apple's policies. It does not guarantee that any particular feature, third-party service, platform integration, or online service will remain available indefinitely.
All financial transactions are handled directly by Apple. We do not process or store your credit card or billing information.
Refund requests, billing issues, and subscription management requests must be submitted directly to Apple, subject to Apple's applicable terms and policies. You can request a refund through Apple's refund request process.
If you request a refund through Apple, we may share limited information with Apple about whether the purchase was delivered or used, solely to help Apple evaluate the refund request.
If the price or terms of an auto-renewing subscription change, Apple may notify you and may require your consent before the change applies, depending on the nature of the change and applicable law.
The App may offer features that use artificial intelligence to generate suggested Workouts or workout structures.

The Company makes no guarantees regarding the accuracy, safety, or suitability of AI-generated content.
The Company's responsibility to you in connection with your use of the Site and the App (also known as "liability") is limited as much as the law in your country of residence will allow. We are not responsible or liable for any consequential, special, indirect or incidental damages arising out of your use of the Site and the Apps, even if we know that such losses might arise.
You acknowledge that your physical exercise and athletic activities carry certain inherent and significant risks of property damage, bodily injury or death.
By using the Application and performing any Workout, you voluntarily assume all known and unknown risks associated with physical activity, including those arising from Workouts created, shared, or generated through the Application.

To the fullest extent permitted by law, the Company shall not be responsible for any injury, health condition, loss, or damage arising from your use of the Application or from performing any workout.
You agree to indemnify and hold the Company and its subsidiaries, affiliates, officers, directors, agents, and employees, harmless from and against any suit, action, claim, demand or loss (including reasonable legal fees) resulting from any third party claim in connection with:

We reserve the right to update and revise these Terms from time to time by posting an update on this webpage. You will know if these Terms have been revised since your last visit to the website or the App by referring to the "Effective Date" at the top of this webpage. Your use of our Site and Apps constitutes your acceptance of these Terms as amended by us from time to time, and you should, therefore, review these Terms regularly.
To the extent permitted by law, this Addendum and your use of the Application shall be governed by the laws of Western Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts located within Western Australia for any disputes arising out of or relating to this specific Addendum or your use of the Application, excluding disputes related to Apple's standard EULA or billing which are governed by Apple's policies.
